Infosys fires employee - Cleared by the Police

Rashid Hussain, a 35-year-old IT professional claims he too is a victim of terrorism, but with a difference.
Hussain, who had joined hundreds of volunteers to help victims of the May 13 serial blasts in Jaipur, did not realise then that he too would land in the police net as a terror suspect. After 8 days in jail, Hussian was let off after police found no evidence of any terror links. But while he won his freedom, he lost his job.
“Infosys terminated me on flimsy grounds as they didn’t want to keep me after my detention,” Hussain said. He said his example was typical of the treatment meted out to educated Muslim youth, “who face double victimisation — first a bad labelling by the police and intelligence agencies and then harassment at the hands of their employers”.
Hussain said, after his eight-day detention he was asked to rest and then face an internal panel. “They did not allow me to clarify my position and instead dug out a discrepancy in my work experience,” he said. “It’s clear that Infosys didn’t want to keep me. The Infosys HR head is on record saying that they started investigations into my record after my detention.”
He said he was picked up on June 1 and kept in illegal detention. “Police found nothing to substantial their claim that I was involved and had links with SIMI,” said the engineer from a Bangalore college. “After blasts, I had involved a number of NGOs in helping the victims as I was moved by the amount of human sufferings.” He said he met around 120 blast victims and shared their pain. “I kept telling them that we should work together to defeat the perpetrators of the blast who are out to destroy our secular fabric.”

The sad fact is that police clearance means nothing in this country. A small bribe would make police let go a potential criminal and terrorist with clean chit. Honestly, how many of us (if we discount religious affiliation) would now have this guy in your close friend circle and allow him to stay in you home for a few days after he got this supposed clean chit.
However bad it may sound, you can not risk a 50 billion dollar business on a dodgy police clearance.

Every company does a background check before recruiting for employement.If the person is fired because of connection to a banned group, recriutment should not have happened in first place. Detention does not mean some one is guilty. Really sad to have been fired.

Employee background checks are more for education, past employment and medical history. And not all India companies do well even this.
There is no way a background check in India can uncover personal criminal background. There is no central police agency or Social security number to find a person’s background.
Probably the person was not a terrorist but no one would risk a major terrorist attack and loss of 90,000 jobs, including many on this forum, because after the attack no one gives any business to Infosys.
So when we start losing job because Infosys/Wipro can not support lakhs of employees because of terrorist attacks; we would probably come to this site again to call them the worst employers.
Terrorist sympathizers have brought this upon them themselves. Any good HR manager should think twice hiring anyone who can be a terrorist; even if he looks and sounds innocent. In the recent past, there have been more than 120 IT professionals, some from companies like Infosys, Cisco and Accenture, jailed for their involvement in Bangalore, Ahmadabad, Mumbai bombings. One of them, with an AK-47, was also shot dead in an army encounter. IT manager should constantly scan the potential terrorist employee’s computer including his email traffic.

Your case is very sensitive issue. Well, you explained what is happened to you, that is a great thing to think everyone of us- what to do?
But if you think from infy, did not fire you because you are suspected by police. May be, it is because of the police orders to infy. Police usually asks the company to provide your complete details while you were under enquiry unluckily they found some thing else that is what is led to such situation in your case.
These are the sensitive issues in our country as you also know that’s why it did so.
Submit all facts to your new employer.
Also keep the police clearance certificate, criminal verification clearance form and try in good companies. Also mention that the pain you had because of being in such discrimination, though such discrimination is not a valid for your case.
You will have good career. You are innocent and clear as per police records also, you are also involving in social service activities. That is a good initiative.
Most of the Muslim brothers will hide themselves from such social activities though they have an intension of doing it but because of the controversial situations that arise as the case happened to you. All of us should be the contributors/ responsible to understand and change the current trend in the coming years then there will not be such cases happen.
Police suspected you and cleared you. To say it otherwise they enquired you and then released you. The same case happened to other religions as well so Police are not wrong for what they have done for you.
But your bad luck it unearthed one more fact to infy. Keeping both factors in mind they have taken such decision. Nothing is wrong from either side when such sensitive cases occur.

There is clear status from Police investigation and he is social service representative who is feeling more responsible for spending time for helping the victims than most of us. Even after suspecting, enquiring and clearing the status also we should not be in assumption that ‘May be …” because the “May be …” case is a “Clear” case now. He is having more and more right to be an infosion than many others whose criminal records are un-verified, did you have it checked by infy for that matter? I know the answer is a NO. If you are innocent and some one suspects you then you will understand the pain of “How your own words hurt the innocent brothers”. And the post is in a public folder it is been read by many innocent bothers. Infy is an equal opportunity employer there should not be any discrimination for any one who is eligible for the job, you are a HR personnel I don’t need to explain you how much it matters when we are in India.
Even if you do an enquiry on each and every one of the employees also it hardly matters because most of the terrorist activists are first timers and if his record is a terrorist then he will not be left out side to work for a job and he will be in jail.
And who have a regular education in India in normal schools and colleges are not at all required to be enquired. A proper passport is sufficient.
There is no risk at all to retain him if safety is concerned but the reason why he has to leave is two fold as I mentioned above.

Commenting on Rob’s statement: Rob, you said that the sad fact is that police clearance means nothing in this country. However there are several elements of unsound arguments in your interpretation
From your statement, the converse can also be concluded which is someone might have been arrested/penalized/accused because he did not pay the bribe - i know there are plenty of cases of potential accuse like for whom no evidence was found. If you do not see police statements as an authority statement, why are you then even considering that arrest.
OK, granted you want to protect your 50 mill $ company by firing Rashid. What will you do if someone who is apparently an engineer, gets posted at your US client site - just goes and blasts off a building there . Can you protect your company of damage,
In effect the risk of a 50 billion dollar business getting damaged due to rogue employees is always there - it does not depend on police
activity.
Its the same as saying, Mr.X said that Mr. Y has aids. Since Mr. Y works in our company we will fire him off, because Mr.Y can bribe the doctor and get a HIV negative report.
So companies please do your bit to hire Rashid again with a mention that his humanitarian gestures must be diverted not to bomb blast sites but to thousands of other sufferers in our country.

I am very sorry to hear about your case, but I am not surprised. Infosys is the most corrupt company in India.
You should talk to a lawyer and sue them for firing you because of religious hatred.
I also got an email today that says Infosys submits false resumes to clients.
As a first example - Shruti Verma (Employee Number 62241) is one of the contractors given to Pfizer by Infosys. The resume that was sent to Pfizer mentions that Shruti was working as a software engineer from Jul 2003 to Mar 2005. In reality - Shruti was unemployed in the period of 2003 - 04, and was teaching at an institute in 2004 - 05.
Infosys seems to have this agreement with several small firms which help Infosys manipulate resumes. Modus Operandi: If Infosys wants to ‘improve’ the resume of it’s newly recruited employees, it calls up one of these small firms asking them to issue fake experience letter for the period of time where the employee was unemployed or in an unrelated job profile.
Once the fake documents are issued, Infosys asks the employee to fill in the joining forms again (The forms that were supposed to be filled when any employee joins Infosys). This is done So that if Infosys is caught by clients at a later stage, they can say that it was the employee who was corrupt and provided false credentials to Infosys also).
If anyone has any doubt, you can ask me for documents: I will forward you the email that has all the proofs (including her original resume and false resume).
