Emotional abuse in a BPO company

Hi,

Would like to share something that I have experienced just today. Please do let me know how I should be reacting to this situation.

I was working for a Company based in Dallas on a BOT model from Bangalore. Recently, 10 months earlier they started their own firm here and i still continued to work with the same company. Total years of service to the company is 2.6 years, without a single black mark in that tenure.

All these years, they promised me raise in salary, retention bonus, promotions; but, none materialized for me. Recently, they started planning to send most of the employees for a global-rotation program. My name came up at the last moment after everyone were sent to the US on a 3-month basis. I had gone to chennai to apply for visa and got rejected the first time. Company sent me again for second time, but this time i was to go to US not for 3 months, but for 2 months only.

Everyone who went to US should sign a bond for 1 year from the day they returned back to work, as part of employee retaining initiative.

When i came back after my visa interview, circumstances at my home prompted me to not to go to US, and i intimated my management of the same, but told them that i would be willing to cover the visa costs incurred by the company.

For this, when my passport came back with visa stamped, my TL received it on my behalf and hid it from me. Upon questioning he said tat I have to sign a bond of 1-year even if I go to US or not.

This is something tat has never happened to anyone in our office before. So i refused to do it. My manager asked me the same, and when my answer was adamant, he said that I have to either sign the bond or they will keep the passport and terminate me.

I told my manager that I was sorry to be in a situation where I am not in a position to travel, but at the same time, I would not sign a bond just for the heck of it.

Enraged at my response, i was terminated, my desk cleaned, workstation id locked off, and was sent back home without my passport or any talk of my months salary.

So, please help me to justify their actions and let me know my next course of action.

    please get the email ids of senior management in your company, including the top boss and write to them giving them your contact details. Will not harm to send in a written complaint with your experience to the senior folks at the head corporate office. Make sure you mark Inda and American corporate on this complaint.

    Withholding your passport is a crime and you are legally entitled to file a case against the senior officers of the company and your manager asking for its return - check with a lawyer for your options. As to work, shrug and move on - most companies are not like that, fortunately

    Lodge a police compaliant for forcefuly retaining your passport. When they have laready terminated yopu they don’t have any reason to withhold the passport.

    btw you should list the company name.
    and BE STRONG.

    hey what sort of stupid company is this?? they have no right to withhold your passport…like the advise given on previous posts..lodge a written complain with your ex-seniors and seek legal advise immediately.

    Hey man you are IT professional. This is totally illegal thing.

    You have to do nothing in this matter just call up media and they are more than enough to get you passport back and spoil this company image in market.

    Send a complaint mail to the senior management, seek legal advise & lodge a complaint with police for the passport and do call up media & let them handle the issue in their way as well.

    First thing - post the name of the company here on this site as well send it to the media.

    Holding your passport is a crime, you can file a case against the company. Please talk to a lawyer and also send the copy of the case to US Consulate in Chennai. This will also make the company gets blacklisted in US Consulate…

    Please move ahead and fight for your cause.They have got no rights to keep your passport.Expose this company.Infact, these type of companies shouldn’t exist.But before taking any further steps, please find a suitable job first.

    Hi,

    Thank you for your inputs. Continuing on the same lines.

    I didnt want to go legally against this company since i had worked there for the past 2.5 years. its been 3 weeks past now and still the company has not given my passport back.

    Now the HR has sent me a letter stating that since i did not go to US and since i was absconding from work since 22nd August, they will take action against me as per company rules and regulation and as applicable by law.

    This is not true since the company itself had sent me home on the night of 22nd August.

    Could someone please let me know as to what they might be able to take action and what should my reactions be?

    Hi Friend,

    Hope they are playing with ur life. U r thinking that if move legally they wont give experience letter and everything … Fine … This is also good decision … but dont forget now also they wont give u experience certificate and everything. u just sent a email to all ur higher officials stating that u r likely go to US and i need to join again in the company. Surely they call back u and again ask for 1 year bond. U simply sign that bond .. Now they are thinking u r planning to leave the company,So only u decline to go to US. No company have rights to hold ur passport even if u r in foreign also they dont have rights. U just sign the bond … its easy to breaka bond. But b4 signing clearly read out and sign. And every communication with ur HR,higher officials must be in Email. Once u get emails in ur company id,Forward it to ur personal id. This is for future reference.
